Job Interview Questions : What You Can't Be Asked

Sure, you want the job but you don't have to answer every question



Are you frequently sick? Have you ever been arrested? Do you have any addictions? Does stress sometimes affect your ability to be productive? If a job interviewer asks you any of these questions, he or she may have broken the law.

Increasingly, the job interview is becoming a legal minefield. The Equal Employment Opportunity Commission issued 49 pages of new guidelines on how to conduct job interviews without running afoul of federal disability discrimination laws.

The guidelines stemmed from the passage of the 1990 Americans with Disabilities Act (ADA), a landmark civil rights law for the country's disabled population. Employers are critical of many guidelines. Which they believe further muddy an already murky situation. The guidelines do contain some subtle distinctions. Do you drink alcohol?, for example, is permissible. How much alcohol do you drink per week? is not.

An interviewer who is just trying to put an applicant at ease by asking a few personal questions can quickly cross into forbidden territory. How a question is asked can determine whether it is permissable or not. But, in general, any interview question may be considered illegal if it is used to discriminate to to judge a candidate in a manner that is not job-related. Following is layman's guide to some of the things that you can and can't be asked. If you feel you've been discriminated against, you can contact the Equal Employment Opportunity Commission.

Can: Emplyers can ask you questions that relate specifically to your ability to perform the job with or without reasonable accommodations. For example, if a job involves lifting weights, you may be asked whether or not you can lift those weights.

Can't: You can't be asked to take any medical or psychological test before being offered a job.

Can: It is permissable to ask how many days you took off work the previous years, since the answer will not necessarily lead you to reveal any hidden disabilities.

Can't: You can't be asked any follow-up questions about a particular disability, even if you volunteer that you took time off from a previous job because of that disability.

Can: You can be asked general questions about minor impairments, such as, Do you have 20/20 vision? If you admit your eyesight is not perfect, however, you do not have to say how bad your eyesight actually is.

Can't: You can't be asked about any addictions you may have.


Can: You can be asked about illegal drug use and required to submit to drug tests. But you can only be asked about legal drug use (alcohol intake, supervised medications, etc.) if the prospective employer believes a positive drug test may have been the result of your taking prescribed medicines.

Can't: The results of tests you've taken to explore your honesty, taste, and habits can't be submitted to psychological analysis.

Can: You can be asked to take a fitness test.

Can't: Your blood pressure or other medical tests can't be taken after a fitness test.

Can: If a conditional offer of a job has been made, you may be required to undergo medical and psychological tests. But the offer can only be withdrawn if as a result of the tests it can be proven that any disability you may have would make you incapable of carrying out the job even after reasonable accommodations were made.

Assistants differ in their specializations. To illustrate, there exist executive, administrative, legal and even simply personal assistants. Likewise, an assistant manager would contribute to a store’s management alongside the shop’s manager.

Furthermore, just as in almost everything else, professions differ between them. For example, while it is entirely plausible (and has happened on more than one occasion), that a salesperson or sales associate worked their way up to store manager or even commercial director, even despite lacking higher education, other occupations do not offer the same opportunities. For example, a legal assistant cannot become a lawyer or notary without a law degree, regardless of years of practice and experience in administration of legal affairs, or how good and competent he or she is.

Although the relationship fails to stand across the job market, since many jobs, especially in business and management, state in their employment descriptions that experience equivalent to a degree is an acceptable possibility. Still, as a rule, studies tend to show that better educated and highly skilled individuals earn higher salaries than their less qualified counterparts.

So what are the skills most sought out by employers? Of course, the answer greatly depends on the economy, as well as the field and the position one covets. Notwithstanding, computer, people (interpersonal), organizational and communication competencies seem to be in high demand. Also, writing outstanding CVs (curriculum vitae or resume), cover letters, craftily passing interviews and building a strong professional network all appear to contribute to a successful outcome to the looking for work process

Making the Most of Mutual Funds


There are now more funds than stocks. Hardly a week passes that some publication isn`t coming out with its “exclusive rankings” of the best mutual funds ever. Most of the rankings are perfectly legitimate and loaded with useful information. But if you’re the average investor, you needn’t watch your mutual funds as closely as a three-minute egg. On the other hand, neither should your mutual funds be stored untended for years, like fine wines in a cellar. An annual check-up seems about right.

Different kinds of funds have different investment objectives, that’s generally how funds are grouped so that investors can compare apples with apples. But, in truth, the dividing line between categories can be somewhat squishy. Typically, the funds themselves decide what category they belong in – not some independent authority or government agency. And different publications often classify funds in different categories. What exactly, for example, is the difference between a “growth” fund? How different will the investment strategy of one fund be from another? A careful investor will want to understand the fund classification categories. Following is a brief explanation of categories used to compile funds’ rankings.

Aggressive funds: They seek the rapid growth of capital, often through investment in smaller companies and with investment techniques involving greater-than-average-risk, such as frequent trading, leveraging, and short-selling. This category also includes Small Company funds, a type of und that seeks capital appreciation by investing primarily in stocks of small companies, as determined by market capitalisation.

Growth funds: They invest primarily in equity securities. Current income, if it is considered at all, is a secondary objective.

Total return funds: They include Equity Income funds that invest at least 65 percent of assets in equity securities with above average yields, and Growth and Income funds that seek growth of capital and current income as near-equal objectives, primarily by investing in equity securities with above-average yield for appreciation.

International funds: Among the international funds are European stock funds which generally invest at least 65% of assets in equity securities of issuers located outside the United States; Pacific stock funds, which invest primarily in issuers located in countries in the Pacific basin, including Japan, Hong Kong, Malaysia, Singapore, and Australia; and World Stock funds, with holdings in equity securities of issuers located throughout the world, maintaining a percentage of assets (normally 25 to 50 percent) in the Unites States.

Speciality funds: This type of fund seeks capital appreciation by investing in equity securities in a single industry of sector, like health, technology, utilities, or natural resources.

Hybrid funds: These have substantial holdings in both stocks and bonds, or hold securities that have characteristics of both stocks and bonds.

Convertible bond funds: They invest primarily in bonds and preferred stocks that can be converted into common stocks.

Corporate bond high-yield funds: This type of fund will generally invest 65 percent or more of its assets in bonds rated below investment grade. The price of these issues generally is affected more by the condition of the issuing company (similar to a stock) than by the interest-rate fluctuation that usually causes bond prices to move up and down.

Corporate bond funds: These funds invest in fixed-income securities, primarily corporate bonds of various quality ratings. This category also includes high Quality Corporate Bonds funds that have at least 65 percent of their holdings in securities rated A or higher.

Government bond general funds: This type of fund invests in a blend of mortgage-backed securities, Treasuries, and agency securities.

Government bond treasury funds: These funds invest at least 80 percent of their assets in U.S. Treasury securities.

Government bond mortgage funds: These funds generally invest 65 percent of their assets in securities that are backed by mortgages.

International bond funds: These funds seek current income with capital appreciation as a secondary objective by investing primarily in bonds denominated in currencies other than the U.S. dollar. These bonds are frequently issued by foreign governments. Also includes Short-Term World Income funds that seek income and a stable net asset value by investing primarily in a portfolio of various non-U.S. currency-denominated bonds, usually with maturities of three years or less. Short-term world income funds seek higher yields than a money market fund and less fluctuation of their net asset value (NAV) than a world bond fund.

Municipal bond funds: These funds seek income that is exempt from federal income tax by investing primarily in bonds issued by any state or municipality.
